I myself am a songwriter; I have never embarkedupon this territory. I need some advice.I did a search at BMI & ASCAP for the Publishers of the songs that I want toinclude on my new CD,and found some of themBMI & ASCAP, said the next step is to contact thepublisher. My question is, how shall I approach them? And what procedures are usuallyfollowed after one contacts the publishers regarding material that you wantto cover?I intend to press my own CD's, and distribute some of the Music as mp3's onmy web site, should this be a concern to take into consideration whenapproaching the publisher?

MP3 SONGS FREE DOWNLOADS : I do not know how many copies I will initially press, since it's hard to sayhow many I will sell. It will be the old supply and demand for my CD; if Iget sales, I'll sell them, if not, they'll sit in box near my computer.Any suggestions would be most welcome, since I am totally ignorant on how toproceed here.Sure wish my songwriting group discussed this kind of stuff; where do youfind out about it?--Ray "MusicBear" BakerPutting The Word "Romance" Back Into Music!Web: Soundclips: Sorry about the triple posts; it's this AOL News Server acting up again! :)I am thinking of recording some cover songs by other artists, and I mustadmit my ignorance here. MP3 SONGS FREE DOWNLOADS : ---------------------------------------- ---------------Tiger Mastering LabsThe "indie CD" part is pretty easy....as someone said, usually you can obtainthe necessary license through the Harry Fox Agency (quite a lot of publishersuse HFA to handle mechanical licensing and collections of mechanicalroyalties). However, occasionally you will have to go directly to the publisher for thelicense, if the song or publisher is not part of HFA's "catalog" of representedpublishers/ works. (This happened to me when I wanted to cover an older andmore obscure Jackson Browne song, even though many of Jackson's later catalogwas "administered" through HFA. When I couldn't find the song in HFA'sdatabase, I found the publisher through the ASCAP ACE database and called themdirectly to get the licensing information). The publisher (or HFA) will probably also give you the correct "copy"information that you need to include in any liner notes, etc. (e.g., year ofcopyright, publisher/writer information, PRO affiliation, etc.). This helps toensure that if the song receives airplay, the appropriate performance royaltieswill be distributed to the publisher and writer.

MP3 SONGS FREE DOWNLOADS : If the song is already available on a previous commercial release, the licenseis pretty much automatic (can't really be refused by the publisher). You needto pay the publisher the current rate for mechanicals (7.25 cents per song percopy manufactured/sold). For smaller runs (initial pressings of 1-2thousand CDs or less are common for self-made indie releases), you willprobably be asked to make a lump sum payment for all copies manufactured (comesto about $75 per cover song per 1000 CDs). You might be able to payquarterly based on copies sold, but that "quarterly" accounting is more commonfor larger labels that intend to widely distribute the CD in stores, etc.Songs which have never been recorded/released commercially are a little tougherto get permission to record, since the copyright owner (publisher) has theright to determine who gets the FIRST recording (release) rights on a song. But my guess is these songs you want to cover are favorites of yours from otherartists' albums, so this probably isn't a concern.
